Membership Agreement

1.1 Membership Plans

1.1.5 Non-Transferability

Membership benefits are non-transferable and may only be used by the registered Member.

1.1.6 Membership Eligibility

• • Membership is available only to individuals who are sixteen (16) years of age or older at the time of enrollment.
• • Memberships are individual and non-transferable and may only be used by the registered Member.
• • Guests under sixteen (16) years of age are permitted during staffed/open business hours only when accompanied and supervised by a Member, and must comply with all facility and safety requirements.
• • Individuals under sixteen (16) years of age may not enter or access the facility during off-hours or self-serve access periods, including through a Member's access credentials or reservation.

1.2 Founding Member Promotion

• • The first twenty-five (25) members may receive Birdie membership pricing at the Par annual rate of $1,750.
• • Promotional pricing is valid for three (3) years.
• • Promotional pricing is maintained only if the membership is renewed annually without lapse.
• • If membership is cancelled or allowed to lapse, promotional pricing may be forfeited.
• • Promotional memberships are non-transferable.

1.3 Billing and Payment

• • Membership billing operates on a calendar month cycle.
• • The initial payment is prorated from the signup date through the end of that calendar month.
• • Regular billing begins on the first day of the following month.
• • Monthly memberships automatically renew on the first (1st) day of each month.
• • Annual memberships renew annually unless cancelled before the renewal date.
• • Failure to maintain valid payment information may result in suspension or termination of membership privileges.

1.4 Hours of Operation

• • Monday - Thursday: 11:00 AM - 10:00 PM
• • Friday - Saturday: 11:00 AM - 12:00 AM
• • Sunday: 10:00 AM - 9:00 PM
• • Off-hours are any time outside of posted open hours.
• • Hours of operation may change at the discretion of Albatross Golf Lounge LLC ownership.

1.5 Video Surveillance

Albatross Golf Lounge LLC uses video surveillance for safety, security, and policy enforcement.

• • Cameras may operate in simulator bays, entrances, common areas, and other areas of the facility.
• • Surveillance systems may operate during both open hours and off-hours.
• • Video footage may be used to verify occupancy, guest violations, property damage, safety incidents, reservation compliance, or misuse of the facility.
• • Surveillance systems are not actively monitored at all times and are used primarily for security, safety, and operational review.
• • By entering the facility, Members and their guests acknowledge and consent to video surveillance and recording while present in the facility.
• • Members are responsible for informing their guests that video surveillance is in use within the facility.

1.6 Reservations

• • Simulator bays must be reserved through the designated booking system.
• • Members must follow reservation limits associated with their membership tier.
• • Unused monthly hours do not roll over unless otherwise stated.

1.7 No-Show and Late Cancellation Policy

• • Reservations must be cancelled at least three (3) hours before the scheduled reservation time.
• • Failure to cancel or failure to appear results in a $5 no-show fee.
• • Members who accumulate five (5) or more violations may, at the owner's discretion, be charged $15 per missed reservation.
• • Repeated abuse of the reservation system may result in suspension or termination of membership privileges.

1.8 Bay Capacity

• • A maximum of six (6) golfers are permitted per simulator bay.
• • A maximum of eight (8) total visitors are permitted per bay.

1.9 Guest Policy

• • Guests are permitted during staffed/open business hours only and are included at no additional cost with membership. Guests are strictly prohibited during off-hours self-serve access periods.
• • Members are responsible for the behavior and conduct of any guests they bring into the facility.
• • Members assume financial responsibility for damages or policy violations caused by their guests.
• • Members may not grant access or allow entry to any non-member during off-hours under any circumstances.
• • Guests may be required to sign a liability waiver before participating in activities.
• • Members must be present at all times while their guests are in the facility.
• • Albatross Golf Lounge LLC reserves the right to limit the number of guests per member or reservation at its discretion.

1.10 Property Damage

• • Members may be held financially responsible for damage caused by negligence, reckless behavior, or misuse of equipment.
• • Repair or replacement costs may be charged directly to the Member.

2.1 Acknowledgment of Risk

Participation in golf simulator activities involves inherent risks, including:

• • Being struck by a golf club
• • Being struck by a golf ball
• • Being struck by a rebounding or ricocheting golf ball
• • Slips, trips, or falls
• • Equipment malfunction

Participation may result in serious injury, permanent disability, or death.

2.2 Voluntary Participation

Participants voluntarily assume all risks associated with participation in activities at Albatross Golf Lounge LLC.

2.3 Player Interaction Risks

Participants acknowledge that injuries may occur due to the actions of other participants or guests, including:

• • Being struck by another participant's backswing
• • Being struck by a golf ball hit by another participant
• • Being struck by a ricocheting golf ball

These risks are inherent to golf and simulator play. Participants agree that Albatross Golf Lounge LLC is not responsible for the actions of other participants or guests.

2.4 Release of Liability

Participants agree to release and hold harmless Albatross Golf Lounge LLC, its owners, employees, agents, and affiliates from claims, damages, or injuries arising from participation or use of the facility.

3.1 Hitting Line Rule

Each simulator bay contains a designated hitting line.

• • Only the player actively hitting may stand in front of the hitting line.
• • All other participants must remain behind the hitting line.
• • Entering the hitting area while another participant is swinging or preparing to swing is prohibited.

3.2 Swing Safety

• • Only one golfer may swing a club at a time.
• • Participants must remain aware of golfers preparing to swing.

3.3 Equipment Use

Participants must:

• • Use equipment properly.
• • Avoid damaging simulator screens or equipment.
• • Hit balls only from designated hitting areas.

3.4 Children

Children must be supervised at all times and may not enter the swing area while someone is hitting.

3.5 Unsafe Conduct

The following behavior is prohibited:

• • Reckless swinging
• • Running inside the facility
• • Entering other simulator bays
• • Interfering with other players

Albatross Golf Lounge LLC reserves the right to remove individuals from the facility for unsafe conduct.

4.1 Access System

• • Members receive temporary access PIN codes generated by the booking system.
• • Access codes are valid only during the reserved booking time.
• • Access codes may not be shared with others.
• • Misuse of access credentials may result in loss of access privileges.

4.2 Alcohol Policy

• • Alcohol is not served during off-hours access periods.
• • Alcohol consumption inside the facility during off-hours is prohibited.

4.3 Facility Responsibility During Off-Hours

Members accessing the facility during off-hours must:

• • Ensure the entry door fully closes immediately after entering.
• • Not allow unauthorized individuals to enter the facility.
• • Ensure the entry door fully closes when leaving.
• • Leave the facility in a clean and orderly condition.
• • Report any damage, equipment malfunction, or safety concerns.
• • Not grant access or allow entry to any non-member during off-hours under any circumstances.
• • Not prop open doors.

Failure to follow security procedures may result in loss of off-hours privileges or membership suspension.
